General Terms and Conditions (GTC) of enigmania 2.0 GmbH

1. Definitions

Insofar as special rights and obligations are agreed in these General Terms and Conditions (GTC) only for consumers pursuant to § 13 of the German Civil Code (BGB) or only for entrepreneurs pursuant to § 14 BGB, the following definitions apply:

  • Consumer: any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity.
  • Entrepreneur: within the meaning of § 14 BGB, a natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

2. Scope of the GTC for entrepreneurs

If the customer is an entrepreneur within the meaning of § 14 BGB, these GTC apply exclusively. The customer’s GTC only apply insofar as enigmania 2.0 GmbH has expressly agreed to them in writing before the respective conclusion of the contract. These GTC also apply to all future transactions between the contracting parties.

3. Contract content

enigmania 2.0 GmbH provides services to consumers and entrepreneurs on the basis of the following GTC and the respective service and product description in the areas of live, outdoor and online escape games.

The principle of an escape game:

  • A group of 2 to 12 people tries to complete a given mission within a certain time (usually 60–180 minutes).
  • Team spirit, logical thinking and dexterity are required.
  • This is supported by game masters or online assistance.

Types of game:

  • Live escape game: takes place indoors at a business location, monitored on site by the game master via camera and microphone.
  • Outdoor escape game: the game runs along a route outdoors, monitored via GPS and partly camera/microphone.
  • Online escape game: can be played from any location; players need a PC/laptop, internet and a means of communicating with each other.

4. Participation in live and outdoor escape games

  • Participation from the age of 18. Under 18 only with the written consent of a legal guardian or accompanied by an adult.
  • Online escape games: minimum age 12; for “Ausgangssperre” and “Der Seelensammler” minimum age 16.
  • Exceptions are possible by written agreement with enigmania 2.0 GmbH.
  • Participation requires consent to monitoring by live stream by the game master. No recording takes place.

5. Conclusion of contract

The booking can be made via the website https://www.enigmania.de/duisburg/, by phone or by email. Verbal commitments are not valid unless they have been confirmed in writing or in text form.

Booking via the website: the presentation does not constitute a binding offer. By clicking the “order with obligation to pay” button, the customer submits a binding request. After submitting the order, the customer receives an order confirmation by email. The contract is concluded with this order confirmation. The contract text is not stored. The contract language is German.

Booking by phone or by email: here too the customer selects the game and provides the required details. After booking, the customer receives an order confirmation by email. The contract is concluded with this order confirmation.

6. Payment

For consumers, the price includes statutory VAT and depends on the number of participants. For entrepreneurs, generally a net amount plus VAT. The amount is due upon order confirmation. Payment by credit card, instant bank transfer, PayPal or on site. Other payment methods are possible on a case-by-case basis.

7. Vouchers

Vouchers can be purchased online or on site. Value vouchers can be used for all bookable events and products. Vouchers that were not purchased are only valid for the specific service or day. No cash payout. Valid for 3 years from the end of the calendar year. Redeemable at enigmania 2.0 GmbH. Subject to price adjustments.

8. Cancellation/change of booking

Fixed rate:

  • Bookings on the fixed rate are binding. There is no claim to free cancellation, rebooking or conversion into a voucher.
  • If the customer does not use the booked time slot, the claim to payment of the agreed fee generally remains in place.
  • enigmania 2.0 GmbH must, however, offset any expenses saved as a result of the slot not being used, as well as anything it earns — or in bad faith fails to earn — by reallocating the slot.
  • The customer is permitted to prove that no damage or significantly less damage was incurred.

Flexible rate:

  • The flexible rate applies exclusively to bookings by consumers and only to bookings of up to two game rooms per calendar day and location.
  • For bookings of more than two game rooms per calendar day and location, the flexible rate does not apply; the conditions of the fixed rate apply.
  • The customer can have the booking converted once, free of charge, into a value voucher for the amount already paid, up to 72 hours before the booked start of play at the latest.
  • A one-off conversion into a value voucher is possible up to 1 hour before the start of play at the latest, against payment of a processing fee of €30.
  • In the event of a cancellation or reduction in the number of participants up to 7 days before the start of play at the latest, the amount already paid will be refunded in full.
  • On the day of play, the number of participants can be reduced by up to two people. The corresponding proportionate amount is credited as a value voucher.
  • Rebookings or voucher conversions are only effective if they are made in good time in text form (e.g. by email) to the respective responsible branch.
  • The claim to a free rebooking or voucher conversion exists only once per booking.

General information:

  • For online escape games there is no claim to cancellation or rebooking.
  • Rebookings and voucher conversions can only take place if free capacity is available for the desired new date.
  • If the relevant deadlines are not met or the customer does not show up for the booked time slot (“no-show”), the claim to payment of the agreed game price remains in place and is due immediately.

9. Liability

Unlimited liability in the event of intent, gross negligence, injury to life, body or health and guaranteed characteristics. In the event of slight negligence only in the event of a breach of cardinal obligations, liability limited to the damage typically foreseeable under the contract. The Product Liability Act and mandatory statutory regulations remain unaffected. No liability in the event of force majeure.

10. Obligations and responsibility of the customer

  • Participation at your own risk. Physical/mental suitability is at the discretion of the participants.
  • Participants with certain health risks are advised against participating.
  • Smoking is prohibited in all rooms.
  • Persons impaired by alcohol or drugs or exhibiting aggressive behaviour: entry prohibited.
  • The game master’s instructions must be followed; violence is prohibited.
  • Intentional damage must be compensated.
  • Photo and video recordings are prohibited in the business premises and game rooms.
  • Solutions, tasks and puzzles are trade secrets; publication is prohibited.

11. Applicable law and place of jurisdiction

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Restrictions due to mandatory provisions of the customer’s state remain unaffected. For merchants based in Germany: place of jurisdiction Duisburg. For others, the statutory jurisdiction applies.
